How does Chapter 13 bankruptcy work?

If you do not qualify for Chapter 7 bankruptcy, Chapter 13 bankruptcy can still help you get debt relief.

In a Chapter 13 bankruptcy, the court sets up a three to five-year repayment plan for you based on what you can afford to pay. The standards for how much you can pay do allow you to live a decent life. Your creditors cannot reject the plan as not good enough. They can't charge you interest or harass you in any way.

Other benefits of Chapter 13 bankruptcy include:

  • Chapter 13 stops creditor harassment immediately. 
  • In some situations, you will not have to repay all of your debt—only what you can afford to pay off during the five-year repayment period. At the end of the plan, any qualifying debt you could not afford to pay off is discharged.
  • Since new interest and penalties on your debt are stopped, your debt doesn't continue to grow while you're trying to pay it down.

When your Chapter 13 repayment plan is complete, the debt is legally paid off. None of your creditors can claim that you still owe them money from before the bankruptcy.
