How does Chapter 13 bankruptcy work?

If you do not qualify for Chapter 7 bankruptcy, Chapter 13 bankruptcy can still help you get debt relief.

In a Chapter 13 bankruptcy, you and your attorney set up a three to five-year repayment plan for you based on what you can afford to pay. The standards for how much you can pay do allow you to live a decent life. Your creditors cannot reject the plan as not good enough. They can't charge you interest or harass you in any way.

Other benefits of Chapter 13 bankruptcy include:

  • Chapter 13 stops creditor harassment immediately.
  • In nearly all situations, you will not have to repay all of your debt—only what you can afford to pay off during the five-year repayment period. At the end of the plan, any qualifying debt you could not afford to pay off is discharged.
  • Since new interest and penalties on your debt are stopped, your debt doesn't continue to grow while you're trying to pay it down.
